The following will was supplied by Bill Hall on May 29, 1997 and is as follows

James Whittaker….Will dated March 12, 1864.
Know all men by these presents that James Whittaker of County of Pulaski state of Virginia in the year of our lord one thousand eight hundred and sixty four being in my natural right mind do hereby devise to my son in law Patrick O’Donald all my right and title to a tract of land lying on the waters of Peak Creek adjoining the land of R. D. Martin??????the land I purchased from Js. Wygal, thereon?of the ??is that the said O’Donald is to have and????the above named tract of land during his lifetime, after his death to be sold and divided among my children these being???that the said O’Donald may at any time if he???es sell and divide the sale proceeds after paying expenses of sale???, if any, with my children as above stated Witness my hand seal this 12th day of March, 1864.

Virginia. At a court held for the county of Pulaski on Thursday the 4th day of August, 1864. The last Will and Testament of James Whittaker deceased was presented in court proved by the oaths of Robert D Martin and William J Martin two of the???????witnesses thereto and ordered to be recorded.

The marriage of James and Sarah Hicks was recorded in Sec. V, Ch. 122, Wythe Co, Va. marriages from 1784 to 1850 CD #229 from Family Tree. June 27, 1997.
Notes by Bill Hall:
James Whittaker’s Will was dated March 12, 1864 in Pulaski County, Va and names only his son-in-law, Patrick O’Donald and is witnessed by William J. Martin, Robert D Martin and Reuben Whittaker. It is located in Will Book #2 (covering 1859-1871) page 198. The will was probated August 4, 1864 in Pulaski County. Source is LDS Microfilm #33397, Pulaski County Wills and Probate 1840-1871.
The 1860 Census of Pulaski Co., Va listed James 73M Laborer, Sarah 79, James 27, laborer; Catherine 39; Henderson 23; Lucinda 22; Susan 16; Sarah C. 1 year. Also, listed Elizabeth which is his daughter with her children: Margaret 5 years and Peter 4 years. Peter was listed in his grandfather’s will.
Beside of James was Andrew Whitaker, Born 1822, which I think is his son and in this household is also listed Reuben 20 year, which I think is James son also and he witnessed his fathers X mark on his Will.
Andrew had the following in his household: Wife Virginia 23; children William C. 4 years and Rebecca J. 1 year. Also Susan, who is 16 maybe a granddaughter, since Sarah would have been 63 at the time she was born. I think these 2 children may have belonged to Catherine.
Also under James’s house hold the one year old Sarah, I think is his granddaughter. I am adding these to the tree until otherwise proven wrong, so as not to loose them.
