Be it remembered that on the second Monday of January A. D. 1863 at a court of Please and Quarter Sessions held for the county of Ashe at the court house in Jefferson, it being the 12th day of said month the following justices of the peace were present and holding said court.

Ordered by the court that John Eldrith be appointed administrator on Wm. H. Perry, Dec’d filed a bond of one thousand dollars with Solomon Perry, security.

Ordered by the court that Andrew McMillan be allowed till the next term of the court to make a return on the estate of Andrew Turner Dec’d also that Wm. J. Warden be allowed.

Ordered by the court that Squire Fouts be appointed overseer of the raod from David Howell’s to the store house near Edwardses with the following hands, Jacob Fouts, Clisby Edwards, John Walker, Columbus Crestte?, David Trivett.

Ordered by the court that Isaac Wilson be allowed ten dollars & forty cents as coroner.

Ordered by the court that George D. Reynolds be appointed Entry Taker.

Ordered by the court that John Eldrith be appointed administrator of the estate of Jonathan Perry Dec’d. Bond for five hundred dollars with Solomon Perry security.

Ordered by the court that John Weaver, Esq, Elihu Weaver, Washington Miller & James Sapp be appointed to lay off the dower allowance of Jane Perry, widow of Wm. H. Perry (Dec’d).

Same as above David Eldrith.

Ordered by the court that Capt. Joseph Hardin be allowed two hundred & thirty nine dollars for expenses of his company to the rail road.

Also that Capt. W. H. Gentry be allowed one hundred & eighty two dollars the same as above.

Ordered by the court that the Jailor be allowed sixty cents per day for boarding prisoners.

Ordered by the court that the Sheriff take George L. McGuire to Raleigh and deliver.

Ordered by the court that J. M. Carson be allowed eighty five dollars for extra services.

Ordered by the court that James Wagg be allowed eighty-five dollars for extra services.

A deed executed by D. Smith & his wife, Ester to John S. Forester was produced in open court and the due execution there of was proven by the oath of J. Trivett the subscribing witness thereto and it is further appearing that the said Feme Consort Ester Smith is unable from bodily infirmity to attend court, it is ordered that Joseph Hudler & D. S. Windle, Esqs be appointed commissioners to take the private examination of the said Ester Smith touching her willingness to execute the said deed and report to the next term of this court.

Ordered by the court that Daniel Blevins be appointed Administrator of David Blevins (Dec’d) and that he enter into bond of two thousand dollars Bond filed with David Dixon & Peter Eller Security.

Ordered by the court that John F. Greer, Esq. And William Baker, Esq. Be appointed to settle with J. H. Carson, guardian of the heirs of John S. Carson.

Ordered by the court that E. F. Foster & Q. F. Neal be appointed to settle with Andrew Dickson, admr. Of James Dickson (Dec’d).

Ordered by the court that William Baker, Esq. & Jarrott Duvaul, John Jones & Calvin Sheets freeholders be appointed to lay off her year’s allowance out of the estate of husband David Blevins, deceased.

Ordered by the court that James Jonsey be appointed Administrator of George Jonesy (Dec’d) and that he enter into bond of two hundred dollars. Bond filed with David Burkett security.

Ordered by the court that Nancy Jinkins be appointed Administrator of Calvin Jinkins (Dec’d) that she enter into bond of one thousand dolalrs with Thomas Sutherland security.

Ordered by the court that C. H. Johnson, Esq., John Orsborn, Z. Baker, Stephen Thomas, free holders Be appointed to lay off for her years allowance out of the estate of her husband Calvin Jenkins (Dec’d).

Ordered by the court that John H. Carson be allowed five percent on John Carson’s estate amt. $521.40cts.

The Last will & testament of Samuel C. Jonesy was duly proven in open court and ordered to be registered.

Ordered that Sarah Jonesy [3 words illegible] appointed Administrator with the will annexed & she enter into bond in the sum of four hundred dollars.

A majority of the justices being present Joseph Dobson, Esq. Was duly elected county attorney for Ashe County.

Ordered by the court that George H. Hamilton & James Wagg be appointed a committee to settle Mr. A. H. Bower, as administraor of the estate of George Bower (Dec’d) and report to the next term of this court.

Ordered by the court that George H. Hamilton, Q. F. Neal, and James Wagg be appointed to asertain the value of the Legacies given by Coln. George Bower in his will in order to assertain the amount of taxes that shall be due thereon.

The following justices being present, David Worth, (illegible), J. P. Waugh, it appearing that George Reynolds has been duly elected entry taker for the county of Ashe (illegible) bond was presented with C. B. Philips & Eli Graybeal security & the said Geo. D. Reynolds was qualified according to law.

It appearing to the satisfaction of the court there was a mistake in the calculation of interest in this case. It is ordered by the court that the clerk ascertain the true amount due the plantiff and issue his execution thereupon.

Ordered by the court that John Goodman Sen. Be appointed administrator of Harvey Goodman (Dec’d) and that he enter into bond & gives Jacob Goodman for security for the sum of two hundred dollars.

Ordered by the court that John Richardson, Q. F. Neal be appointed Administrators of Canada Richardson (Dec’d) & that they enter into bond with James Gambill & James Richardson security for twenty thousand dollars, the oath of administrators duly qualified according to law and it appears to the court that for the purposes of distribution became nessary that the Negroes belonging to said estate should be sold, it is therefore ordered by the court that the said Admrs. Do proceeede to sell the same on six months credit.

Ordered by the court that H. M. R(illegible), Henry Rollins, Samuel C. Waugh be appointed patrolls in the Town District.

Ordered by the court that Henry Mash be appointed Administrator of John Mash (Dec’d), enter into bond with Ambrose Coldiron security for six hundred dollars, was duly qualified according to law.

Be it remembered that on the (illegible) of February A. D. 1863 at a court of Please and Quarter Sessions held for the county of Ashe at the court house in Jefferson, it being the 2d day of said month the following justices of the peace were present and holding said court.

[First action illegible] Polly Cox, exparte, Petition for years allowance.

Ordered by the court that Mathew Carson, Carter Wade, James A. H(illegible), Andrew Long be appointed to lay off her year’s allowance.

On the 20th day of February 1863 the following justices of the peace, to wit, William Weaver, John Baker, Eli (illegible), Esqrs. Met at the office of the county court at the court house in Jefferson. Granted (illegible) special administration on the estate of Ephraim (illegible). It appearing the said estate is in such situation as to require the immediate (several words illegible) the said special administrators is required to give bond & security with sum of two thousand dollars bond filed with Stephen Thomas security & said administrator qualified according to law (several words illegible) take into his hand the said estate until the next term of this court and that he expose to sale the horses, cattle, hogs and sheep grain and meet on hand belonging to said estate.

Be it remembered that at a special term of the court of Please and Quarter Sessions called by authority of an act of the legislature this the 10th day of March 1863 open and held in the court house in Jefferson present presiding and holding the same the following justices of the peace, to wit: Rich’d. T. Hardin, Eli Graybeal, James Sapp, Jas. W. Hardin, Joseph McMillan, John Poe, Wm. Weaver, Geo. H. Hamilton.

[Although it is not stated, it would appear that this is a list of magistrates appointed in various districts of Ashe County. Alternately, it could be payment for patrol services, though from the list of names, it is a less likely scenario.]

Were sworn in Magistrates.

At a call session of the court of Please and Quarter Sessions for said county twenty one magistrates being present, it is ordered by the court that he secretary of War be requested to suspend the execution of the conscription law as to all the loyal citizens of Ashe County and that John W. Martin, Esq. & Q. F. Neal be appointed to writ upon the said Secretary and in present a petition to that effect.

At a call court of Ashe County being the 17th day of March, 1863. Present James P. Waugh, H. H. Rollins & Geo. H. Hamilton.

Ordered by the court that we think it essential for sheriff have some deputies especially in the disloyal section of the county we respectfully ask the Honorable Secretary of War to grant the prayer of the Sheriff’s petition.

Ordered by the court that John Reves be allowed forty dollars for expenses for Wilson’s Company and the interest of D. Worth’s note.

William Baker binds himself in the sum of fifty dollars to be void if Robert Phipps & John Hash appears here at the next jury term of the court and not depart the court without leave of the court.

It appearing to the satisfaction of the court that Theophilus Woody is the father and next of kin of Bryant Woody who was First Liet. In Co. A, 34th Regt. N.C. C.A. is commanded and decreeded that Theophilus Woody be appointed administrator on the estate of the said Bryant Woody and thereupon Theophilus Woody comes into court and files his bond in the penal sum of eight hundred dollars with John W. Martin and William Baker as securities which bond is approved by the court and the said Theophilus Woody comes and takes the oath prescribed by law for administrators.

A majority of justices being present. Quincy F. Neal, Esq. Was elected county commissioners for the county of Ashe in persuance of an act of the general assembly entitled and act for the relief of the wives & families of soliders in the army ratified Feb. 10th 1863 for the purpos of necessity & distributing the funds due to our said county and gives bond in the sum of twenty- two thousand five hundred dollars & fifty cents with J. B. Parsons, Andrew Dickson, and John Ray as securities. Bond accepted by the court.

Ordered by the court a majority of the justices being present that John Reves, David Worth, Jonson Perkins, N. H. Waugh & Geo. H. Hamilton be appointed a committee to regulate the distribution for the relief of the wives & families of soliders in the amry and the regulation which they adopt from time to time shall be the regulation of this court.

Ordered by the court that John H. Whitman and Thomas Wayman, Stephen Pennington & D. S. Windle be appointed to lay off the years allowance for Rebecca Young.

Ordered by the court that the assessors be allowed two dollars per day and the Justices of the Peace one percent for taking in tax list.

Ordered by the court that Dr. E. F. Foster & E. C. Bartlett be appointed to settle with John Richardson & Q. F. Neal administrators of Canada Richardson.

Ordered by the court that sheriff J. M. Carson be allowed thirty two dollars & fifty cents for taking George A. McGuire to Raleigh.

Ordered by the court that Jahu Goss be appointed to take the list of taxable property for Horse Creek District provided that John Eldreth’s health not such that he can.

Ordered by the court that Z. Baker & C. H. Jonson be appointed to settle with John Orsborn administror of Jesse W. Allen.

On the 6th day of July, 1863, the following justices of the peace, to wit: H. H. Rollins, N. C. Waugh, & William Weaver, Esqrs. Met at the office of the county court at the court house in Jefferson and granted David Smith, Esq. Special letter of administration on the estate of Hugh Smith (dec’d) it appearing that said estate is in such situation as to require the immediate care of some person, the said special administration is required to give bond and security in the sum of ten thousand dollars. Bond filed with Evan McCarroll security. And the said Administrator qualified according to law and it is further ordered that the said special administrator take in to his posession the said estate until next term of this county court and that he expose to sale the horses, hogs, sheep & cattle and also its grain and meet in hand.

It appearing that publication has been duly made for & notice joined on all the defendants & they failing to appear it is orderd that judgment proconfisco [sic] be entered against them. It is further orderd that the said admr. Procede upon the premises after due advertisement to sell the land mentioned in the pet. On a credit of six month & the funds when collected may be assets in his hands to pay debts & charges against the estate.

It is ordered by the court that a settlement [illegible]. Returned made with Mis. A. C. Bower, adminx of Coln. George Bower Dec’d committee heretofore appointed be confirmed.

At a special term of the county court of Ashe County, Held at the Clerk’s office in the court house in Jefferson, on 26th day of Dec. 1863, present James P. Waugh, Saml. C. Waugh, H. H. Bolling, Esqrs. Special letters of administrator was granted to Joseph Bryant upon the estate of Noah Weaver, (Dec’d) upon giving bond in the sum of one thousand dollars and the said admr. Shall collect and take into his possession of the estate of the said dec’d and also to expose to sale upon a credit of six months one mare & colt. Bond filed with J. P. Waugh & Q. F. Neal, security & he qualified according to law.
