Land transaction between George Lineberry – Orville Anderson and Franklin Clements
This indenture made this 28th day September 1842 between George Lineberry of the County of Carroll and State of Virginia of the one part and Orville Anderson and Franklin Clements of the same place of the other part witnesseth that the said George Lineberry for and in consideration of the sum of one hundred dollars lawful money of Virginia to him in hand paid by the said Orville Anderson and Franklin Clements before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath given granted bargained sold and conveyed and by these presents doth give grant bargain sell convey and confirm to the said Orville Anderson and Franklin Clements their heirs and assigns one undivided half of a certain tract or parcel of land lying and being in the county of Carroll in the State of Virginia on Little Cranberry Creek …… containing three hundred acres by survey with its appurtenances and being the same tract or parcel of land by this commonwealth granted to Thomas Evans and the said George Lineberry by patent bearing date on the 30th day of November 1838. To have and to hold one undivided half of the tract or parcel of land hereon before mentioned and described with the appurtenances unto them the said Orville Anderson and Franklin Clements their heirs and assigns to the only proper use and behoof of the said Orville Anderson and Franklin Clements theirs heirs and assigns forever.
And the said George Lineberry for himself, his heirs, executors and administrators doth hereby covenant and agree to and with the said Orville Anderson and Franklin Clements their heirs and assigns there he will forever warrant and defend one undivided half of the tract or parcel of land aforesaid with its appurtenances unto them the said Orville Anderson and Franklin Clements their heirs and assigns against him the said George Lineberry and his heirs and against all persons whomsoever claiming the same or any part there of by from through or under him but against the claim of no other person or persons whomsoever.
In witness where of the said George Lineberry hath here unto set his hand and affixed his seal the day and year first herein written.
