Minutes of the Ashe County, North Carolina Court of Pleas and Quarter Sessions 1865

August Term, 1865

NOTE: This was the first session of the county court in 1865, and the first after the Civil War. The entire county government was reorganized, and this in this record.]

Be it remembered that at a meeting of the justices of the peace appointed by the provisional governor of the State of North Carolina at the court house in Jefferson on the 1st day of August, A.D. 1865, present the commissioner for our said county, Mathew Carson, Esquire, When the following persons as justices appointed and commissioned as aforesaid appeared and took the amnesty oath and oath of office to wit: R. T. Hardin, C. H. Johnson, John Weaver, John Ham, John Duvaul, Wm. Sexton, Wm. Baker, John Jones, Samuel Bower, John H. Carson, Wm. B. Carson, Wm. R. Colvard, J. B. Parsons, N. P. Waugh, Johnson Perkins, John S. Howell.
Qunicy F. Neal is appointed clerk protem.

The above justices being present, it is ordered by the court that E. C. Bartlett be appointed commissioner of the public buildings.

It is ordered that all the justices meet at the court house in Jefferson on Monday next the 7th Inst. Court then adjourned.

Ashe County

Court met 7th of August 1865 according to adjournment in the court house in Jefferson. Present all the foregoing named justices being present. David Worth & Geo. W. Ketchum appeared in open court and took the amnesty oath and oath of office as justices of the peace for our said county. The magistrates then proceeded to the Election of the following officers:

Ordered by the court that Jesse Eller be appointed overseer of the road from Jefferson to the ford of the Creek at Hugh Smith’s place with the former hands.

Ordered by the court that Ruben Wallis be appointed overseer of the rod from Jacob Wallises to the graded road near Alfred Barker with Henry Francis, Wiley Wilton, Geo. Brooks, Jas. Brooks, St. Leger Brooks, Thos. Barker, Alex Barker, David Barker, Bartlett Stike, Wm. Stike.

Ordered by the court that Harrison Goodman be appointed overseer of the road from the Gap of the Mulatto Mountain to the Cross roads on Pine Swamp with the old hands.

Ordered by the court that John Baldwin be appointed overseer of the Road from Blake Ballows old Mill down to [illegible] Poweres with the all the hands in the old boundaries.

Ordered by the court that Mark Hardin be appointed overseer of the road from Jefferson to Hamilton’s Mill with the following hands: Calvin Graybeal, David Graybeal, W. R. Duke, B. P. Switser, John Ray, Jr., W. H. Hamilton, James Dickson & Geo. Hamilton & Phelix Ray.

The court then proceeded to elect a special court whereupon Geo. H. Hamilton, David Worth & Matthew Carsons was elected Also. Geo. H. Hamilton, appointed chairman of the court.

Also R. T. Hardin the Clerk filed his bond with Jas. W. Hardin, M. Carson, W. B. Carson, John H. Carson & E. C. Bartlett securities and was qualified according to law.

The Sheriff J. M. Carson elected appeared and filed his bond with Johnson Perkins, David Dickson, S. S. Pennington security qualified as the law directs (all the justices of the peace were present).

The Register Andrew Hawthorn elected appeared in open court and filed his bond with John Ray, Sen. As security in the sum of ten thousand dollars and qualified according to law.

Ordered by the court that William Thompson be appointed overseer of the Road from the Mouth of Little Helton to William Baker’s with the same hands that belonged to said road heretofore.

Ordered by the court that Joseph Blackburn be appointed overseer of the Road from Edwards’ store house to the ford of the River at David Howell’s with the same hands that was formally on said road.

Be it remembered that a court of Please and Quarter Sessions is this day opened and held in the town of Jefferson the 4th Monday of August 1865, it being the 27th day of the said month the following Justices of the Peace being present & presiding and holding said court to wit:

The last will and testament of Levi Gentry is duly proven in open court by the oaths of the subscribing witnesses thereto and ordered to be recorded wid. Nancy Gentry one of the executors named appears and renounces her Right to qualify as one of the executors. Therein named Jarrott B. Duvall & Clark Porter the other executors of the said will comes in and are qualified as the law directs.

Ordered by the court that John Weaver be appointed Administrator with the will annexed on the estate of Jonathan Miller dec’d and that he enter into bond in the sum of two thousand dollars. Bond filed with John S. Ashley, David Miller, security, and qualified according to law.

Ordered by the court that Aley Miller be appointed Administrator on the estate of Washington Miller dec’d and that she enter into bond in the sum of six hundred dollars. Bond files with Jourdan Sheets security and qualified according to law.

Ordered by the Court that Elizabeth Edwards be appointed Administratrix on the estate of Clisby Edwards and that she enter into bond in the sum of one thousand dollars Bond filed with Jacob B. Houck & Jacob Houck, Sen. Security & qualified according to law.

A majority of the acting justices of the peace being present, proceeded to elect a county solicitor, resulted in the election of R. F. Armfield for Ashe County.

Ordered by the Court that all persons who have received or taken and carried away any iron from the jail of the said county are hereby ordered to appear on or before the next term of the court and give due bill with security for the return of said iron when called for due bill to be given to E. C. Bartlett Commissioner of Public Buildings and if not the law will be put in force against them.

Ordered by the court that Nancy Hart be appointed Administratrix on the estate of Elisha Hart, dec’d and that she enter into bond in the sum of three hundred dollars. Bond filed with James Sapp and Larkin Ham security and she was qualified according to law.

Ordered by the court that John Ham be appointed Administrator on the estate of Thomas Ham, dec’d, and that he give Bond in the sum of four hundred dollars. Bond filed with Richard Perry security and him qualified according to law.

Ordered by the court that Squire Trivett be appointed administrator on the estate of Owen Trivett, deceased, and that he give bond in the sum of nine hundred dollars. Bond filed with J. E. Foster & H. H. Rollins security. He qualified according to law.

The report of the Commissioners appointed to settle with Dr. James Wagg, Executor of Hugh Smith, Dec’d is now returned and in all things confirmed. It is further ordered that said executor be allowed four percent commission on the amt. Of assets that come into his hands.

A paper writing purporting to be the last will & testament of Miss. Elizabeth Smithdeal, Dec’d was produced in open court and by consent of the parties [illegible] and heirs it is agreed that the same be set aside and declared null and void & she is hereby declared to have died intestate. And it is ordered that E. C. Bartlett & Tobias Smithdeal be appointed administrators of the said estate of Elizabeth Smithdeal, Dec’d, & that they give bond in the sum of seven hundred dollars. Bond filed with R. T. Hardin, & Q. F. Neal, their security & they qualified as the law directs.

Ordered by the court that E. C. Bartlett & Tobias Smithdeal be appointed Adm’r of the estate of Wm. Smithdeal dec’d upon their giving bond & security in the sum of two hundred dollars. Bond filed with R. T. Hardin & Q. . Neal their securities & they qualified as the law directs.

Ordered by the court that William Miller be appointed overseer of the road from Jefferson to the ford of the river in place of George Bower, with the same hands.

Ordered by the court that David Sexton be appointed overseer of the road in the place of John Baldwin with the same hands formally be longed to John Baldwin and the same road.

Ordered by the court that Geo. E. Miller be appointed overseer of the road from the ford of the River to Geo. E. Miller’s with the former hands that worked on said road.

Ordered by the court that James C. Miller be appointed overseer of the road from Geo. E. Miller’s to Laurel Springs with the former hands that worked on that part of the road.

The last will & testament of Jacob Bare is duly proven in open court by the oath of the subscribing witnesses & ordered be registered ordered that Jesse B. Miller be appointed administrator with the will annexed of the said Jacob Bare and that he gives bond in the sum of two hundred & fifty dollars, bond filed with John H. Wagonner & John Bear securities & he qualified as the law directs.

Ordered by the court that Thos. McGuire be appointed overseer of the [road] from the ford of the river near Miss Cooper’s to the mouth of Elk with the hands on the following farms, to wit: Lewis Churches, Harvey Phillipses, Geo. Shepherds, Wesley Phillipes, Milas McGuires, Thos. McGuires, & Wiley Churches River farm.

Ordered by the court that W. P. Gentrey be appointed overseer of the raod from the Wattauga line to Calloways Gap with the following hands there on, David Stansberry, Geo. Lorances, H. Grogan, Giles Graham, Wm. Jonese, Miley Green, M. Bledsoes farm & David Howell’s farm & the old Calloway Farm.

Ordered by the court that Noa Greer be appointed over seer of the road from Calloway’s Gap to Jonathan Spivey’s with the following farms & hands there on, to wit: A. Jackson’s, William Gentry, M. Calloway, Reuben Jones, Elija Greer’s Farm, Rebecca Lorances, John Ingrams, David Rash & Jo. Rashes.

John Baker, John Orsborne, John Pennington & Jesse McMillan who was appointed Magistrates appeared in open court and was duly qualified as justices of the peace.

Ordered by the court that W. H. Blevins be appointed administrator of the estate of John Ward, Dec’d, and that he enter into bond in the sum of three hundred dollars.

John M. Carson sheriff of Ashe County appeared in open court and tendered his resignation and it was accepted by the court.

Ordered by the court that Noah Black be appointed overseer of the road from the Sandy Flat to the top of the mountain with the former hands that belonged to said road.

E. C. Bartlett Justice of the Peace appeared in open court and tendered his resignation which was accepted by the court.

The court proceeded to appoint William Latham Sheriff of Ashe County the following justices of the peace were present, to wit:

William Latham filed his Bond in the sum of thirty thousand dollars with David Worth, David Eller, John Orsborne & John Bennington as securities and was qualified according to law to fill out the provisional term of J. M. Carson.

Ordered by the court that Gideon Weaver, Mathias Miller be appointed administrators on the estate of John Weaver, Dec’d and that they enter into bond in the sum of five thousand dollars. Bond filed with John Baker & John Ham securities & they qualified according to law.

Ordered by the court that the Admrs. make sale of all the personal property belonging to said estate.

The court proceeded to elect a surveyor for Ashe County which resulted in the election of William Johnson who filed his bond with A. B. McMillan & George Koonce as securities and was qualified according to law.

Ordered by the court that A. B. Cox be appointed guardians for the heirs of Wm. McMillan, Mahaly Jane, Hardin R., Nellie A, Sarah & Jesse C. McMillan. Bond filed with A. B. McMillan security in the sum of one thousand dollars.

Ordered by the court that A. M. Maxwell be appointed overseer of the road from S. C. Jones’ to the ford of the river opposit the church near Worth’s with the former hands belonging to said road.

Ordered by the court that William Night be appointed overseer of the road from Thos. Cornutt’s to Baldin’s Gap on the stone mountain with the same hands that worked under Jesse Orsborne.

Ordered by the court that Elizabeth Brown be appointed Administratrix of the estate of Lewis Brown deceased & that she enter into bond in the sum of three hundred dollars bond filed with John Orsborne security.

Procede to sell the lands as prayed for in the petition on a credit of six months, the proceeds to be assets in his hands to pay debts & expenses of Admrs. and make return to the next term of this court.

A deed of conveyance from Marion & Hiley Beamon [illegible] to W. M. Baldwin here to fore proven and a commission issues to J. B. Parsons & J. F. Greer to take the private examination of the said Fem. Covent Hiley Beamon is here returned with the report of said commissioners and on motion the said deed with said comrs. Report is ordered to be Registered.
